New York Assemblyman Gary Pretlow submitted another piece of legislation to legalize online poker in the Empire State.

From an online poker perspective, the start of New York’s 2017 legislative session looked a lot like the year before. Bonacic introduced similar online poker legislation. Assemblyman Pretlow introduced an identical bill to the Assembly. However, something was different. He had been quick to dismiss its chances in years past.

In June 2016, Gary Pretlow sought to have the online poker bill receive a floor vote, but last-minute budget battles led to the bill dying in committee. That meant the entire process had to restart in the 2017 and 2018 legislatures. Online poker lost momentum, despite a successful vote in the New York Senate.

Pretlow, the chairman of the Racing, Gaming and Wagering Committee, introduced A 4924 to the state assembly last week. It’s the second piece of online poker legislation filed this year by the state’s lawmakers. Sen. Joseph Addabbo introduced SB 18 to the state Senate last month.

Outside of one key difference, the two bills are very similar. Addabbo’s bill has a ‘bad actor’ clause in it and Pretlow’s more recent bill does not. Addabbo’s bill would likely keep some of the bigger companies in the online poker space, such as PokerStars, out of New York.

Both bills seek to reclassify poker as a game of skill instead of a game of chance and would ask operators to pay a one-time $10 million application fee. By reclassifying poker as a game of skill, the state legislature would bypass the need for an amendment to the state constitution.

Pretlow’s bill also contains language that would make it easier for the state to join interstate compacts for online poker, like what New Jersey, Nevada and Delaware currently have. The recent reversal on the Wire Act from the Department of Justice could put the brakes on any new compacts coming in the near future, however.

Pretlow has been one of New York’s most staunch supporters of online gambling. He has either introduced himself, or supported legislation that would legalize online gambling every year for the last several years.

Historically, the bills easily pass the Senate, but have been unable to garner enough support to pass the Assembly. Most industry insiders consider this bill to have a similar fate.

An additional factor working against the passage of Pretlow’s bill is another bill in the legislature. Last month, Assemblywoman Linda Rosenthal introduced a bill which would call for the state’s gaming commission to conduct a study on the extent that its citizens gamble. The study would stretch out for several years and would serve as a tool for anti-gambling lawmakers to hold off on online gambling until the results come in.

Governor Andrew Cuomo hasn’t made a statement either way on his online poker stances.

The purpose of the bill, which is strikingly similar to its Senate counterpart, is “to authorize the New York State Gaming Commission to license certain entities to offer for play to the public certain variants of internet poker which require a significant degree of skill, specifically ‘Omaha Hold’em’ and ‘Texas Hold’em.’”

The bill would authorize the New York State Gaming Commission to license such games by amending the Racing, Pari-Mutual Wagering and Breeding Law.

'Presently, numerous New York residents are participating in illegal, unregulated and unsafe gaming operations which offer games of chance over the Internet,' the bill states. 'This bill will allow the state to license operators that meet the high standards set by the state and offer limited games of poker which require a high level of skill. This bill will require such operators to take steps to protect consumers, combat compulsive gaming, and prevent minors from accessing online gaming sites.'

Other highlights from the bill include:

The state would offer up to 10 licenses for interactive gaming;
Each license would cost $10 million and be good for ten years;
Operators would have to pay 15% tax on their “interactive gaming gross revenue”;
Anyone that operated in the U.S. after Dec. 21, 2006, like PokerStars and Full Tilt Poker, would be ineligible for a license;
Certain standards must be enacted to protect against underage gaming, fraud and compulsive gambling;
Regulations would be due 180 days after passage of a bill. Consequently, licenses would not be issued for at least 180 days after that; and
The bill allows for interstate compacts.

The bill continues: “The legislature further finds that as the internet has become an integral part of society, and internet poker a major form of entertainment for many consumers, any interactive gaming enforcement and regulatory structure must begin from the bedrock premise that participation in a lawful and licensed gaming industry is a privilege and not a right, and that regulatory oversight is intended to safeguard the integrity of the games and participants and to ensure accountability and the public trust.”

Neither of the bills are expected to make much movement in 2014, though Bonacic believes such bills will help spur discussion at a time when nearby states are either taking advantage of or exploring iGaming.
